1. Definitions
"Platform" means the ProiectulPixel.ro/us/ web application, all associated Netlify Functions, and any content generated by the Platform. "User" or "you" means any individual or legal entity accessing or using the Platform in any capacity. "Report" means any PDF, HTML, or on-screen output generated by the Platform. "Credits" means the prepaid digital tokens that enable Report generation. "Third-Party Data" means all data sourced from Google Maps Platform, OpenStreetMap, Walk Score, U.S. Census Bureau, Bureau of Labor Statistics, FBI Crime Data Explorer, city open data portals, and any other external provider.
2. Acceptance of Terms
By creating an account, purchasing Credits, or using any feature of the Platform in any way — including simply viewing output — you explicitly, irrevocably, and unconditionally accept these Terms in their entirety. If you do not agree with any provision, you must immediately cease all use of the Platform. Your continued use constitutes ongoing acceptance of any updates to these Terms.
3. Nature of Service — Strict Informational Tool Disclaimer
THE PLATFORM IS AN AUTOMATED INFORMATIONAL TOOL ONLY. Nothing generated by the Platform constitutes, or should be interpreted as, business advice, legal advice, financial advice, real estate advice, investment advice, tax advice, accounting advice, zoning advice, regulatory guidance, or professional advice of any kind whatsoever.
Specifically, Reports generated by the Platform:
- Do NOT guarantee commercial viability, profitability, or success of any business venture;
- Do NOT constitute a recommendation to open, close, invest in, or avoid any business location;
- Do NOT account for zoning laws, local regulations, permits, or licensing requirements;
- Do NOT represent current market conditions, as data may be outdated or incomplete;
- Do NOT replace physical site visits, market research, or consultation with licensed professionals;
- Do NOT provide legally binding assessments of any kind;
- SHOULD NOT be the sole or primary basis for any business, financial, or investment decision.
4. Comprehensive Data Limitations and Disclaimers
4.1 Completeness and Accuracy
The Platform makes no representation, warranty, or guarantee — express or implied — regarding the completeness, accuracy, reliability, suitability, timeliness, or availability of any data presented. The Platform explicitly disclaims all responsibility for:
- Missing data: Businesses, locations, and points of interest that exist in the real world but are not listed in any data source used by the Platform;
- Incorrect data: Businesses or locations that are listed but have incorrect names, categories, addresses, coordinates, or any other attributes;
- Stale data: Information that was accurate at time of collection but has since changed due to business closures, openings, relocations, or any other reason;
- Omissions: Any category, type, or classification of business that the Platform does not track or represent;
- Duplicate entries: The same business appearing multiple times or under different names in data outputs;
- Misclassifications: Businesses assigned to incorrect categories by third-party data providers;
- Geographic inaccuracies: Incorrect coordinates, boundary data, radius calculations, or map representations.
4.2 Google Maps Data
Competitor and business data is sourced from Google Maps Platform (Places API). The Platform has no control over the quality, completeness, or accuracy of Google Maps data. Coverage varies by geography — dense urban areas have more complete listings than rural or newly developed areas. Businesses that do not list themselves on Google Maps will not appear. The Platform explicitly disclaims all liability for any decisions made based on competitor data derived from Google Maps.
4.3 Walk Score Data
Walk Score, Transit Score, and Bike Score are proprietary scores provided by Walk Score (walkscore.com). These scores are estimates based on Walk Score's proprietary methodology and may not reflect actual walkability conditions. The Platform disclaims all liability for the accuracy or applicability of Walk Score data.
4.4 U.S. Census Bureau Data
Demographic data is sourced from the U.S. Census Bureau American Community Survey (ACS) 2022 5-Year Estimates. This data: (a) reflects survey estimates, not exact counts; (b) may have significant margins of error, particularly for small geographic units; (c) reflects conditions as of the survey period and may not represent current demographics; (d) is aggregated at the block group level and does not represent precise local conditions. The Platform disclaims all liability for any decisions made based on Census data.
4.5 Population and Housing Estimates
Estimated population and housing unit counts per radius are calculated by the Platform using a density extrapolation method based on Census block group data. These are approximations only, not actual counts. Actual population within any radius may differ substantially from estimates due to geographic boundaries, land use patterns, and other factors not captured by the estimation method.
4.6 Crime Data
Crime data is sourced from FBI Crime Data Explorer and city-specific open data portals. This data: (a) reflects reported crimes only, not total crime incidence; (b) may be subject to reporting delays and revisions; (c) is provided at county or city level and may not reflect conditions at the specific analyzed location; (d) should not be used as the sole indicator of safety for any location. The Platform disclaims all liability for decisions made based on crime data.
4.7 AI-Generated Analysis
Analytical text, recommendations, and opportunity scores generated by the Anthropic Claude API are produced by an artificial intelligence model and may contain inaccuracies, hallucinations, contradictions, or content that is inapplicable to the User's specific situation. AI-generated content does not constitute professional advice. The Platform disclaims all liability for the accuracy or applicability of AI-generated content.
4.8 Opportunity Score
The Opportunity Score (0–100) is an algorithmic indicator calculated using a weighted formula combining competitor density, walkability, and demographic income data. It is not a comprehensive market assessment, does not account for all relevant business factors, and is not predictive of business success or failure. The same score may represent very different market conditions in different geographic contexts.
4.9 API and Service Availability
The Platform relies on third-party APIs that may be unavailable, degraded, rate-limited, or discontinued without notice. In the event of third-party API failure, Platform outputs may be incomplete, absent, or based on fallback data of lower quality. The Platform disclaims all liability for service interruptions caused by third-party dependencies.
4.10 High-Density Areas and Partial Competitor Data
In areas with very high business density (such as major metropolitan centers), the volume of competitor data may exceed what can be retrieved within the Platform's processing limits. In such cases: (a) the analysis is limited to the 1-mile and 2-mile radii for primary (direct) competition; (b) the 3-mile radius is omitted and replaced with an explanatory notice in the report; (c) secondary (related) competition is not included; (d) a credit is still consumed, provided complete data for the 1-mile radius was successfully retrieved; (e) the Opportunity Score is based on the 1-mile radius, which remains complete. The User acknowledges that for high-density locations the report reflects the immediate (1–2 mile) primary competitive environment only, and accepts that a credit is consumed for such reports.
5. Credits, Payments, and No-Refund Policy
5.1 Nature of Credits
Credits are prepaid digital tokens that enable Report generation. Credits are a digital product with no physical component. One Credit is consumed upon each completed analysis, regardless of whether the User considers the output useful or satisfactory.
5.2 Deduction Policy
A Credit is deducted only upon successful completion of an analysis. If an analysis fails due to a technical error on our side before completion, the Credit is not deducted. However, the Platform makes no guarantee regarding data quality or completeness, and deduction of a Credit upon analysis completion does not imply that the output meets any quality standard.
5.3 Absolute No-Refund Policy
ALL SALES ARE FINAL. CREDITS ARE NON-REFUNDABLE UNDER ANY CIRCUMSTANCES, except in the sole case of verified non-delivery caused by a technical error on the Platform's side. By completing checkout on Stripe, you explicitly acknowledge and agree that: (a) the digital service is delivered immediately upon payment confirmation; (b) you waive any applicable right of withdrawal or cooling-off period; (c) this waiver is irrevocable from the moment of payment.
Dissatisfaction with data quality, completeness, or accuracy does not constitute grounds for a refund. Credits never expire and remain in your account until used.
6. Methodology — ProiectulPixel.ro
6.1 How the Opportunity Score is calculated
The score (0-100) measures the attractiveness of a location for the selected business type, relative to existing competition in the area. The calculation considers:
- The number of direct competitors (same business type) within 1-mile and 2-mile radii;
- The number of indirect competitors (related categories selected by the user), capped at 15% impact on the score;
- The relative density of competition versus the analyzed radius.
Interpretation thresholds: ≥70 = strong opportunity, 45-69 = moderate opportunity with risks, <45 = saturated or risky. The score is a comparative analysis instrument, not a guarantee of commercial success. The final decision belongs to the User and must integrate external factors (rent, accessibility, branding, capital, etc.).
6.2 Official data sources
- Competition (businesses): Google Maps Platform (Places API) — business data including name, address, category, rating, review count, and operational status. Closed businesses (permanently or temporarily) are automatically filtered;
- Map tiles and public points of interest: OpenStreetMap (OSM), distributed under the ODbL license;
- Address ↔ coordinate geocoding: Nominatim (OSM project);
- Walkability metrics (Walk Score, Transit Score, Bike Score): Walk Score® (walkscore.com);
- Demographic data (population, median household income, median age, housing units): U.S. Census Bureau — American Community Survey (ACS) 2022 5-Year Estimates, at the Census Block Group level;
- Unemployment data: U.S. Bureau of Labor Statistics (BLS), at the county level;
- Crime data (where available): FBI Uniform Crime Reporting (UCR) Program, at the county level, plus city-specific open data sources where published.
6.3 Geographic coverage
ProiectulPixel.ro (US) works for any address across the United States where the underlying data sources have coverage. Demographic granularity is at the Census Block Group level (approximately 1,500 residents on average).
6.4 Known limitations
- Business data: Sourced from Google Maps; coverage depends on businesses listing themselves on Google. Some operators may not appear if they do not maintain a Google Business Profile;
- Different granularity: Demographic data is at the Census Block Group level, while unemployment and crime data are at the county level — these broader areas may not reflect immediate neighborhood conditions;
- Population estimates by radius are calculated from local Census Block Group density and represent approximations, not exact counts;
- Update frequency: Data is refreshed occasionally, as source agencies publish new releases. The reference year is shown for each figure;
- Comparisons are provided for context only and should not be interpreted as predictive guarantees;
- High-density urban areas: Google Places API limits each query to 20 results. In hyperdense zones (e.g., Manhattan central, San Francisco Financial District), the Platform uses a denser query grid to capture more competitors, but some may still be omitted. When this happens, the report displays a clear notice indicating the limitation.
- Restaurant category — cuisine sub-type coverage: Google Maps classifies restaurants into 111 distinct cuisine sub-types (Italian, Mexican, Chinese, Japanese, Thai, etc.). Google Places API limits each query to a maximum of 50 sub-types. The Platform prioritizes the 50 most common cuisine types in the US market — including the generic "restaurant" type and the most prevalent ethnic cuisines (American, Mexican, Italian, Chinese, Japanese, Thai, Vietnamese, Korean, Indian, Mediterranean, French, Greek, Spanish, Middle Eastern, breakfast/brunch, seafood, barbecue, sushi, vegan/vegetarian, and others). Rare ethnic specialties not in this prioritized list (e.g., Tibetan, Scandinavian, Hungarian, Croatian, Czech, certain regional Asian cuisines) may not appear in reports. The 50 prioritized sub-types cover an estimated 95% or more of restaurants in typical US markets. When the "Restaurant" category is selected as primary or secondary type, the report displays a clear notice about this limitation.

7. Comprehensive Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM, ITS OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, including but not limited to: direct damages, indirect damages, incidental damages, consequential damages, special damages, exemplary damages, punitive damages, loss of profits, loss of revenue, loss of data, loss of business opportunity, loss of goodwill, business interruption, or any other financial or non-financial loss.
This limitation applies regardless of: (a) the theory of liability (contract, tort, negligence, strict liability, or otherwise); (b) whether the Platform was advised of the possibility of such damages; (c) the failure of any limited remedy to achieve its essential purpose.
Specific excluded liabilities include but are not limited to:
- Losses arising from reliance on missing, incomplete, inaccurate, outdated, or erroneous data;
- Losses arising from business decisions made based on Platform outputs;
- Losses arising from failure of third-party APIs or data sources;
- Losses arising from inaccuracies in AI-generated content;
- Losses arising from service interruptions, downtime, or technical failures;
- Losses arising from data breaches or unauthorized access;
- Losses arising from changes to third-party data sources or APIs;
- Losses arising from competitor data omissions or misclassifications;
- Losses related to real estate transactions, lease agreements, or property investments made based on Platform data;
- Losses related to business investments, franchise fees, or capital expenditures made based on Platform data.
In any jurisdiction where limitation of liability is not permitted, the Platform's total liability shall not exceed the amount paid by the User in the thirty (30) days preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Platform, Gușa Mihai Mădălin PFA, and their respective officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any business decisions made based on Platform outputs.
9. Intellectual Property
Reports generated by the Platform are licensed to the purchasing User for internal business evaluation purposes only. Reports may not be resold, redistributed, published, or used in institutional financing applications or investor materials without clearly noting in prominent text that the data is sourced from an automated informational tool and does not constitute professional analysis.
10. Acceptable Use
Prohibited uses include: automated scraping or bulk downloading; reverse engineering; use in regulated financial products, securities filings, or institutional loan applications without appropriate professional verification; any illegal purpose; misrepresentation of Platform outputs as professional analyses.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Romania. Any disputes shall be submitted to the competent courts of Romania. Users may also refer to A.N.P.C. SAL for alternative dispute resolution.
12. Modifications
The Platform reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform after publication of updated Terms constitutes acceptance of all changes. It is your responsibility to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable. All other provisions remain in full force and effect.
